Terms of Service

Please read these Terms of Service carefully before using SurfBoard. By creating an account or using our service, you agree to be bound by these terms.
1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and SurfBoard App ("SurfBoard," "we," "us," or "our"), a business entity operating under the laws of the State of Florida, United States.
By accessing or using SurfBoard's digital display management platform at surfboardapp.pages.dev or any associated domains (the "Service"), you agree to these Terms. If you do not agree, do not use the Service.
2. Description of Service
SurfBoard provides a cloud-based digital display management platform that allows businesses to upload images and content for display on smart TVs and screens via a unique URL. The Service includes:
- Display board creation and management
- Image upload and storage
- Announcement ticker functionality (Pro plan)
- Scheduled content display (Pro plan)
- Agency client management portal (Agency plan)
- Remote display updates via web dashboard
3. Account Registration
To use SurfBoard you must create an account by providing your business name, email address, and password. You agree to:
- Provide accurate, current, and complete information
- Maintain the security of your password and account
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activity that occurs under your account
You must be at least 18 years old to create an account. By registering, you represent that you meet this requirement.
4. Subscription Plans and Payment
4.1 Free Plan
SurfBoard offers a free plan with limited features including up to 2 display boards, single image per board, and a small advertisement overlay on displays. The free plan is provided at no charge and may be modified or discontinued at our discretion with reasonable notice.
4.2 Pro Plan
The Pro plan is available at $18.00 per month or $180.00 per year, billed through Stripe. Pro features include unlimited boards, image carousel, announcement ticker, scheduled content, and no advertisements.
4.3 Agency Plans
Agency plans are available at the following rates:
- Starter: $29.99/month or $299.90/year (up to 5 clients)
- Growth: $79.99/month or $799.90/year (up to 15 clients)
- Pro: $99.99/month or $999.90/year (unlimited clients)
4.4 Billing
All payments are processed securely by Stripe. By subscribing, you authorize SurfBoard to charge your payment method on a recurring basis. Prices are in US dollars and exclusive of applicable taxes.
4.5 Cancellation and Refunds
You may cancel your subscription at any time through the Stripe Customer Portal accessible from your account dashboard. Upon cancellation:
- You retain full Pro access for 30 days following cancellation
- After the 30-day grace period, your account reverts to the free plan
- Your display boards and uploaded content are retained but subject to free plan limitations
- SurfBoard does not provide refunds for partial billing periods
5. Acceptable Use
You agree to use SurfBoard only for lawful purposes. You must not upload, display, or transmit content that:
- Violates any applicable law or regulation
- Infringes any third-party intellectual property rights, including copyrights and trademarks
- Is defamatory, obscene, offensive, hateful, or discriminatory
- Contains malware, viruses, or malicious code
- Misrepresents your identity or affiliation
- Promotes illegal activities
SurfBoard reserves the right to remove content and suspend or terminate accounts that violate these standards without prior notice.
6. Content Ownership and License
You retain full ownership of all content you upload to SurfBoard ("Your Content"). By uploading content, you grant SurfBoard a limited, non-exclusive, royalty-free license to store, display, and transmit Your Content solely for the purpose of providing the Service.
You represent and warrant that you have all necessary rights to upload and display Your Content and that it does not infringe any third-party rights.
7. Advertisements
Free plan users acknowledge that SurfBoard may display third-party advertisements on their display boards. Pro plan subscribers and agency clients are not subject to advertisements. SurfBoard is not responsible for the content of third-party advertisements and does not endorse any advertised products or services.
8. Service Availability
SurfBoard aims to provide continuous service availability but does not guarantee uninterrupted access. The Service is provided on an "as is" and "as available" basis. We may perform maintenance, updates, or experience outages that temporarily affect availability. SurfBoard is not liable for any losses arising from service interruptions.
9. Data and Privacy
Your use of SurfBoard is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.
10. Intellectual Property
SurfBoard and its associated technology, branding, design, and software are owned by SurfBoard App and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our express written consent.
11. Limitation of Liability
To the maximum extent permitted by applicable law, SurfBoard App shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service, even if advised of the possibility of such damages.
SurfBoard's total liability to you for any claims arising under these Terms shall not exceed the total amount paid by you to SurfBoard in the twelve (12) months preceding the claim.
12. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. SurfBoard does not warrant that the Service will be error-free or uninterrupted.
13. Indemnification
You agree to indemnify, defend, and hold harmless SurfBoard App and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in Brevard County, Florida, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.
If you are located outside the United States, you agree that disputes will be resolved under Florida law and you consent to jurisdiction in Florida.
15. Changes to Terms
SurfBoard reserves the right to modify these Terms at any time. We will notify users of material changes by updating the effective date above and, where appropriate, by email. Continued use of the Service after changes constitutes acceptance of the revised Terms.
16. Termination
SurfBoard may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases and we may delete your data after a reasonable retention period.

Privacy Policy

SurfBoard App is committed to protecting your privacy. This Privacy Policy explains what information we collect, how we use it, and your rights regarding your personal data.
1. Who We Are

2. Information We Collect
2.1 Information you provide directly
- Account information: business name, email address, and hashed password when you create an account
- Payment information: billing details processed securely by Stripe — SurfBoard does not store credit card numbers
- Content: images and files you upload to display boards
- Communications: messages submitted through our contact form
2.2 Information collected automatically
- Usage data: pages visited, features used, board activity, and last active timestamps
- Device and browser information: browser type, operating system, and screen resolution
- IP address: collected by Cloudflare for security and performance purposes
- Analytics: page views and navigation patterns via Cloudflare Web Analytics (privacy-first, no cookies)
2.3 Information from third parties
- Stripe: subscription status, payment confirmation, and billing history
- Meta (Facebook/Instagram): ad interaction data if you reach SurfBoard through a paid advertisement
3. How We Use Your Information
We use the information we collect to:
- Provide, maintain, and improve the SurfBoard service
- Process payments and manage subscriptions
- Send transactional emails (account confirmation, billing notifications)
- Respond to support requests and contact form submissions
- Monitor and prevent fraud and abuse
- Analyze usage patterns to improve the product
- Send marketing communications (you may opt out at any time)
4. Data Storage and Security
Your data is stored on Cloudflare's infrastructure (R2 object storage and Workers) located in the United States and distributed globally via Cloudflare's network. Cloudflare maintains SOC 2 Type II compliance.
We implement the following security measures:
- Passwords are hashed using SHA-256 and never stored in plain text
- All data transmission is encrypted via TLS/HTTPS
- Authentication uses signed JWT tokens with expiry
- Payment data is handled exclusively by Stripe (PCI DSS compliant)
No method of transmission or storage is 100% secure. We cannot guarantee absolute security but take reasonable steps to protect your information.
5. Data Sharing
We do not sell your personal information. We share data only with:
- Stripe: to process payments and manage subscriptions
- Cloudflare: to host and deliver the service
- Meta Platforms: aggregated conversion data for advertising (no personal data is shared)
- Law enforcement: when required by applicable law or legal process
If you are an agency client, your account information may be visible to the agency that manages your account.
6. Cookies and Tracking
SurfBoard uses:
- Local storage: to maintain your login session (no cookies used for authentication)
- Cloudflare Web Analytics: privacy-first analytics that do not use cookies or fingerprinting
- Meta Pixel: to measure advertising effectiveness — tracks page views, leads, and account registrations. You can opt out via Meta's ad preferences.
7. Your Rights
Depending on your location, you may have the following rights regarding your personal data:
- Access: request a copy of the personal data we hold about you
- Correction: request correction of inaccurate data
- Deletion: request deletion of your account and associated data
- Portability: request your data in a machine-readable format
- Objection: object to certain processing of your data
- Opt-out of marketing: unsubscribe from marketing emails at any time

8. California Privacy Rights (CCPA)

9. International Users (GDPR)
If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, you have rights under the General Data Protection Regulation (GDPR). Our legal basis for processing your data is:
- Contract performance: processing necessary to provide the service you signed up for
- Legitimate interests: analytics, security, and fraud prevention
- Consent: marketing communications (you may withdraw consent at any time)
Data transfers outside the EEA are made to Cloudflare and Stripe, both of which maintain Standard Contractual Clauses and appropriate safeguards.
10. Data Retention
We retain your account data for as long as your account is active. If you delete your account, we will delete your personal data within 90 days, except where retention is required by law. Uploaded images and board content are deleted upon account termination.
11. Children's Privacy
SurfBoard is not directed at children under 13 years of age. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we will delete it immediately.
12. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify you of material changes by updating the effective date above. Continued use of the Service after changes constitutes acceptance of the revised policy.
