4. Subscription Plans and Payment

4.1 Free Plan

SurfBoard offers a free plan with limited features including up to 2 display boards, single image per board, and a small advertisement overlay on displays. The free plan is provided at no charge and may be modified or discontinued at our discretion with reasonable notice.

4.2 Pro Plan

The Pro plan is available at $18.00 per month or $180.00 per year, billed through Stripe. Pro features include unlimited boards, image carousel, announcement ticker, scheduled content, and no advertisements.

4.3 Agency Plans

Agency plans are available at the following rates:

All payments are processed securely by Stripe. By subscribing, you authorize SurfBoard to charge your payment method on a recurring basis. Prices are in US dollars and exclusive of applicable taxes.

You may cancel your subscription at any time through the Stripe Customer Portal accessible from your account dashboard. Upon cancellation:

You agree to use SurfBoard only for lawful purposes. You must not upload, display, or transmit content that:

SurfBoard reserves the right to remove content and suspend or terminate accounts that violate these standards without prior notice.

6. Content Ownership and License

You retain full ownership of all content you upload to SurfBoard ("Your Content"). By uploading content, you grant SurfBoard a limited, non-exclusive, royalty-free license to store, display, and transmit Your Content solely for the purpose of providing the Service.

You represent and warrant that you have all necessary rights to upload and display Your Content and that it does not infringe any third-party rights.

7. Advertisements

Free plan users acknowledge that SurfBoard may display third-party advertisements on their display boards. Pro plan subscribers and agency clients are not subject to advertisements. SurfBoard is not responsible for the content of third-party advertisements and does not endorse any advertised products or services.

8. Service Availability

SurfBoard aims to provide continuous service availability but does not guarantee uninterrupted access. The Service is provided on an "as is" and "as available" basis. We may perform maintenance, updates, or experience outages that temporarily affect availability. SurfBoard is not liable for any losses arising from service interruptions.

9. Data and Privacy

Your use of SurfBoard is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

10. Intellectual Property

SurfBoard and its associated technology, branding, design, and software are owned by SurfBoard App and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our express written consent.

11. Limitation of Liability

To the maximum extent permitted by applicable law, SurfBoard App shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service, even if advised of the possibility of such damages.

SurfBoard's total liability to you for any claims arising under these Terms shall not exceed the total amount paid by you to SurfBoard in the twelve (12) months preceding the claim.

12. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. SurfBoard does not warrant that the Service will be error-free or uninterrupted.

13. Indemnification

You agree to indemnify, defend, and hold harmless SurfBoard App and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in Brevard County, Florida, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

If you are located outside the United States, you agree that disputes will be resolved under Florida law and you consent to jurisdiction in Florida.

15. Changes to Terms

SurfBoard reserves the right to modify these Terms at any time. We will notify users of material changes by updating the effective date above and, where appropriate, by email. Continued use of the Service after changes constitutes acceptance of the revised Terms.

16. Termination

SurfBoard may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases and we may delete your data after a reasonable retention period.

SurfBoard is not directed at children under 13 years of age. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we will delete it immediately.
